Mauritius: Employment Rights Act & Employment Relations Act 2008 to be amended

Government will soon amend the Employment Rights Act and the Employment Relations Act 2008, with a view to introducing a new set of rules to be implemented by one and all to enable the country to make further advancement in the field of industrial relations.

The announcement was made, this morning, by the Minister of Labour, Industrial Relations and Employment, Mr. Shakeel Mohamed, at the Grand Mauritian Hotel in Balaclava, at the opening of a two-day workshop on “Conciliation and Mediation Users on Conflict Management and Functioning of the Commission for Conciliation and Mediation”.

According to the Minister, the Government has already put in place a legal and institutional framework, which not only responds to economic imperatives but also better protects workers, promotes collective bargaining both in public and private enterprises and effectively strengthens tripartism and social dialogue.

An initiative of the Ministry of Labour, Industrial Relations and Employment in collaboration with the Association of Human Resource Professionals and the Nelson Mandela Metropolitan University, Port Elizabeth, South Africa, the workshop is in line with the action plan of the Commission for Conciliation and Mediation.

The aim of the workshop is to give every user of the conciliation and mediation process an opportunity to assess the achievements of the Commission and also to make an appraisal of its functioning in relation with the Employment Rights Act.

Some fifty Human Resource Managers from both the public and private sectors are attending the workshop. The participants will be exposed to the useful and effective techniques of conciliation and mediation in the resolution of labour disputes in the workplace by means of a mixture of conflict resolution and mediation theories especially with regards to modern workplaces which are prone to conflicts.

It will be recalled that following the enactment of the Employment Rights Act and the Employment Relations Act 2008, and their coming into effect in February 2009, the Industrial Relations Commission was replaced by the Commission for Conciliation and Mediation. The main function of the Commission for Conciliation and Mediation is to provide conciliation as well as mediation services on any labour dispute referred to it.

The Customer Service Charter on the functional structures of the Commission for Conciliation and Mediation was also launched this morning as well as the website of the Commission.
